Veteran’s Beware – Make sure you investigate your Service Connected Pension!
A number of so called professionals, are out there, saying the right things, “we care about you”,” we want to serve you for nothing” etc, but as I have said previously, there is no such thing as a free lunch!
If you have a service connected injury, you can and should pursue this type of pension. However, most professionals are interested in Aid and Attendance. Why? They make money off of you. How? For filing a VA application it is against the law to charge for this service. Therefore, when they say, “we’ll do this for nothing” it is not from the goodness of their heart, it’s because it is against the law!
Additionally, assume a typical elder couple, been married for decades, only marriage, enlisted and not retired.
For Service Connected:
1. Money
a. No asset & income test
b. Non-taxable
c. Award to widow will be higher than A&A. If the DIC claim is problematic, file for NSC. Because filing for NSC, the VA must also consider DIC in the case of a surviving spouse, so you cover both bases.
2. Eligibility
a. Widow of veteran whose death resulted from SC condition or illness or is the nexus, regardless of % rating, receives $1,154.00 is base. If the widow is housebound, add another $135.00; if she needs A & A, add another $286.00 per month.
b. If veteran was rated 100% for at least eight years, add $246.00 per month to the base of $1,154.00. In order to qualify with a non service related death, the veteran must have been rated 100% for at least ten years prior to death, $1,400.00 base without housebound or A & A
c. Widow of veteran who was a POW and had a 100% rating for at least a year immediately before he died, if he died after 9/30/99, $1154,00 is base without housebound or A & A.
d. Widow of vet who was rated 100% when he was discharged and he remained at 100% for at least 5 years, $1,154,00 is base without housebound or A & A.
3. Add-on's
a. If she needs Housebound, add $135 to above.
b. If she needs A&A, add $286 to above.
