The payment to a non-spouse family member for a Veteran’s care can be used as UME, provided money is exchanged. This money (income to non-spouse family member) canot be utilized to pay for any declared UME, because all countable UME must be paid by the claimant.
The non-spouse family member may use the money to pay for non-medical expenses of the claimant, without it considered income to claimant…this is family maintenance. The non-spouse family member may incur a personal tax liability due to the income paid, see IRS website.
A sitter or home care affidavit needs to accompany the application.
