A typical scenario, a married Vietnam Vet, with children, exposed to Agent Orange, has heart and diabetes issues, complications with diabetes, has leg amputated, but has not requested any VA Benefits or help from the VA. Regarding VA Benefits, what is “Presumptive” Service Connection?

Participated in atmospheric nuclear testing; occupied or was a POW in Hiroshima or Nagasaki; service before 2/1/92 at a diffusion plant in Paducah, KY, Portsmouth, OH, or Oak Ridge, TN; or service before 1/1/74 at Amchitka Island, AK

When converting an IRA to an immediate annuity for VA purposes, the immediate annuity does not have to have an actuarially sound pay-out.

However, beware of the Medicaid annuity trap; Medicaid has different terms than the VA.

No. There is no waiting period to re-apply for Veteran’s Benefits, after you become eligible.

Regarding Veteran’s Benefits – What is a Survivor Benefit Plan?

The Survivor Benefits Plan (SBP) is money paid by the Department of Defense to a surviving spouse, whose military retired spouse (typically 20 years plus in service) paid into the system.

A Veteran filed an initial lock in date, for Veteran’s Benefits,but has yet to file an application because Asset Planning is required, can the planning cause the claim to be rejected?

This question is not an issue of the claim being rejected; but the major issue is FRAUD.

Is their an organization or group that is willing or able to serve as personal representative and fiduciary, for the veteran, if they have no family etc?

The VA requested that the Assisted Living Facility monthly charge be broken down into Base Rate and Medical & Nursing Services, to be eligible for Veteran’s Benefits.

Our philosophy is, if they request it, give it to them. However, in this case, the veteran was rated A & A by the doctor.

Why a world war two veteran was denied Aid and Attendance at an assisted living facility?

The Veteran was denied due to the word “Protective environment” not being on the doctor’s affidavit.

What do you do when a Veteran is physically unable to sign documents?
